Terms & Conditions

This page (together with the documents referred to on it) tells you the terms and conditions on which we supply any of the products (Products) listed on our website TLC Beauty Therapy.com (our site) to you.  Please read these terms and conditions carefully and make sure that you understand them, before ordering any Products from our site.  You should understand that by ordering any of our Products, YOU AGREE to be bound by these terms and conditions.

You should print a copy of these terms and conditions for future reference.

 Information about us

We operate the website TLC Beauty Therapy.com  We are TLC Beauty Therapy  (“we” “our” “us”),  with our office at High Meadows, Wilsden, Bradford, BD15 0HN.

2. Service Availability

We accept orders worldwide. Please get in touch with our Customer Services Team through the CONTACT PAGE between 9.00am and 5.30pm, Monday – Friday to discuss any special requests and to obtain more information.

3. Your Status

By placing an order through our site, you warrant that:

(a)    you are legally capable of entering into binding contracts; and

(b)    you are at least 18 years old;

(c)    you are resident in one of the Serviced Countries; and

(d)    you are accessing our site from that country.

4. How the contract is formed between you and us

4.1 You can place the order for the Product(s) on our site by clicking the ‘Buy Now’  button on the Payment page of the checkout process.

4.2 After placing an order, you will receive an e-mail from us acknowledging that we have received your order.  Please note that this does not mean that your order has been accepted.  Your order constitutes an offer to us to purchase our product(s).  All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (Dispatch Confirmation).  The contract between us (Contract) will only be formed when we send you the Dispatch Confirmation. 

4.3 The contract will relate only to those products whose dispatch we have confirmed in the Dispatch Confirmation.  We will not be obliged to supply any other products which may have been part of your order until the dispatch of such products has been confirmed in a separate Dispatch Confirmation.

4.4 Payment will be taken immediately.

4.5 Your order will be dispatched within 48 hours, according to the delivery option you have selected during the checkout process on the website.

4.6 All Products shown on the Website are subject to availability at the time of placing your order.

5. Price and Payment

5.1 The price of the Products and our delivery charges will be as quoted on our website and are as stated, except in cases of obvious error. 

5.2 Product prices are inclusive of VAT. However, if the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the Products in full before the change in VAT takes effect.

5.3 Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.

5.4 Despite our best efforts, some of the Products listed on our site may be incorrectly priced.  We will normally verify prices as part of our dispatch procedures so that, where a Product's correct price is less than our stated price, we will charge the lower amount when dispatching the Product to you.  If a Product’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your order and notify you that we are rejecting it.

5.5 If the pricing error is obvious and unmistakable and could have reasonably recognised by you as an error, we do not have to provide the Products to you at the incorrect (lower) price.

5.7 Payment for all Products - we accept payment with; Paypal, MasterCard, Maestro, Visa, Visa Debit, and Visa Electron.

6. Promotions

Promotional codes are limited to 1 use of discount code per person and cannot be used in conjunction with any other offer or discount. Subject to availability. TLC Beauty Therapy reserve the right to remove this offer at any time. No price adjustments will be made for promotional codes not entered at the time of purchase.

7.  Availability and Delivery

7.1 All Products shown on the website are subject to availability at the time of placing your order.

7.2 Products will posted out within 48hours receipt of cleared funds, Monday to Friday. 

7.3 Your order will be fulfilled by the delivery date set out in the Dispatch Confirmation or, if no delivery date is specified, then within 30 days of the date of the Dispatch Confirmation, unless there are exceptional circumstances. 

7.4 Delivery will be undertaken by Royal Mail. Orders will be tracked to delivery point and a photograph taken of delivery. Delivery time guidelines quoted are those stated by Royal Mail and once goods have left the premises are under the control of that company. We may assist with tracking orders but you must be aware there may be delays due to weather, transportation issues and any other force majeure and we will not accept liability in these instances.

7.5 For Royal Mail Special Delivery Guaranteed Next Day, orders must be placed by 12pm to be processed that day.

7.6 When you receive the goods you should immediately inspect them for damage and faults. You should inform us within 24 hours if you do not consider that you have received the goods you ordered, if you consider that the goods are faulty or damaged, otherwise, the goods will be considered to have been correctly delivered, free from damage or faults and in good working order. This will be without prejudice to any damage or fault you could not have discovered on reasonable inspection of the goods. 

8. Products delayed or lost in the post

8.1  The preferred courier is Royal Mail.

Tracked 24, delivery aim 1-2 working days.

Tracked 48, delivery aim 2-3 working days.

Next Day delivery, the next working day. (Orders must be placed by 12pm to be processed that day)

Worldwide International Tracked & Signed, allow 10 days.

Royal Mail do not guarantee timescales nor do they consider an item to be lost in the post until 10 working days after the due delivery date.

PLEASE NOTE - We are not liable for items lost or damaged in the post but will complete a Royal Mail Claim form on your behalf. The compensation received from Royal mail will be refunded to you through the original payment method. Refunds are less shipping costs and paypal or credit card processing fees, incurred by ourselves.

8.2 Claims for compensation of loss must be made within 80 calendar days of placing the order. Claims made after that time will not be accepted.

9. Risk

9.1. The Products will be at your risk from the time of delivery.

9.2. Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.

9.3. Upon receipt you must inspect the Products. You will be deemed to have accepted the Products unless you notify us that you have cancelled the order and/or you return the Products in accordance with the Returns Policy. If no such action is taken by you we shall not be obliged to accept any rejection of the Products at a later date. Your statutory rights are not affected.

10. Retention of Title

10.1 Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges and any other charges owed by you.

11. Consumer Cancellation Rights

11.1 If you are contracting as a consumer, you may cancel a Contract at any time within seven working days, beginning on the day after you received the Products.  In this case, you will receive a full refund of the price paid for the Products in accordance with our refunds .

11.2 To cancel a Contract, you must inform us in writing by e-mailing us at enquiries@tlcbeautytherapy.com, quoting your full name, order reference number, date and value of the order and your method of payment. You must also return the Products to us within 14 days beginning on the day you received the Products, and at your own cost.  You have a legal obligation to take reasonable care of the Products whilst they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.

11.3 If you wish to amend or cancel your order on the same day of placing the order, you must contact our Customer Services Team immediately or as soon as possible after your order has been placed between 9.00am and 5.30pm, Monday – Friday via email enquiries@tlcbeautytherapy.com.  If your order has already been dispatched then your payment will still be processed in the usual way, this is very likely because we process orders immediately upon receipt.  In these circumstances it will not be possible to amend or cancel your order and it will be necessary to follow the cancellation procedure as detailed in the returns policy.

11.4 You will not have any right to cancel a Contract for the supply of any of the following Products if:

 (a)   the goods cannot be returned by reason of their nature (for example, if you have opened or used the goods) or they are liable to deteriorate or expire rapidly;

(b)  the goods were sealed and you have opened the seals;

(c)  the goods or it’s packaging are damaged or marked in any way, or have unreasonable wear or are otherwise not in a condition that would be consistent with you having taken reasonable care of them;

(d)  the goods are in a such a condition that they cannot be re-sold at all or for more than 80% of their original value;

(e)  you are not able to return the goods with all the packaging, contents, documents, and other items sold with or as part of the goods, including any free gifts; or

(f)  you sell, transfer, hire or lend the goods or give ownership of the goods to someone any other person.

11.5 Details of your statutory right of cancellation, and an explanation of how to exercise it, are provided in the Dispatch Confirmation.  This provision does not affect your other statutory rights as a consumer.

12. Our refunds policy

12.1 When you return a Product to us because you have cancelled the Contract between us within the seven-day, we will process the refund due to you as soon as we receive the Product back. The Product must be unused, seals and packaging in tact and in a saleable condition. You will be responsible for the cost of packaging and returning the item to us. We will examine the returned Product and process the refund through the original payment method. On receipt of the returned item, you will receive a refund through the original payment method. This refund will be less postage paid and paypal or credit card processing fees, incurred by ourselves.

12.2 If an item was ordered under "Free Shipping" and is later returned, the original shipping charge we incurred together with the Paypal or credit card processing fee will be deducted from the amount refunded, through the original payment method.

12.3 Any refunds will be made less less shipping costs and paypal or credit card processing fees, incurred by ourselves.

13.  Warranty

13.1 We warrant to you that any Product purchased from us through our site will, on delivery, conform with its description, be of satisfactory quality, and be reasonably fit for all the purposes for which products of that kind are commonly supplied. 

13.2 Our sole liability and your sole remedy for breach of this warranty shall be one of the following (at our discretion): 

(a)    we will endeavor to repair the goods;

(b)    we will replace the goods with goods which do conform to the contract; or

(c)    we will take the goods back and refund you all amounts paid by you under the contract.

We shall have no liability for any claims with respect to the goods not conforming to the contract which are made later than 3 months after the date of delivery of the goods. If we elect to repair or replace the goods, then the balance of that 3 month period will apply to any repaired or replacement goods, plus the time taken by us to repair or replace. If we elect to repair or replace the goods and this proves not possible, or disproportionate, or we fail to do so in a reasonable time, then we may and will take the goods back and refund you all amounts paid by you under the contract.

14. Limited warranty of satisfaction

LiLash and LiBrow has a 90-day satisfaction guarantee to see new users through their first 3 months. If a purchaser is not completely satisfied with Product, then the purchaser may return the remainder for a refund less shipping costs and Paypal or credit card processing fees, incurred by ourselves, provided that:

(i) Purchaser returns Product within 90 days of purchase date. (ii) The product was purchased directly through TLC Beauty Therapy. (iii) Purchaser returns the remainder of Product, at their own cost, with all its original packaging within 7 days (iv) Purchaser has not received a refund for a product purchased from TLC Beauty Therapy or any other stockist.

We will process all valid refund requests in no more than thirty (30) days. If a return is lost in the post, we will honour the refund request only if Purchaser can provide valid proof of return. Valid proof of return is a delivery confirmation or a signature required. Only a single product refund will be allowed for any given name, address, credit card number or Paypal account.

15.  Our liability

15.1 Nothing in this agreement excludes or limits our liability for:

(a)    death or personal injury caused by our negligence;

(b)    fraud or fraudulent misrepresentation;

(c)    any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982;

(d)    defective products under the Consumer Protection Act 1987; or

(e)    any deliberate breaches of these terms and conditions that would entitle you to terminate the Contract; or

(f)     any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.

15.2 Where you buy any Product from a third party seller through our site or by following a link from our site, the seller's individual liability will be set out in the seller's terms and conditions.

16.  Import duty

16.1 If you order Products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination.  You will be responsible for payment of any such import duties and taxes.  Please note that we have no control over these charges and cannot predict their amount.  Please contact your local customs office for further information before placing your order.

16.2 Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined.  We will not be liable for any breach by you of any such laws.

17.  Written communications

Applicable laws require that some of the information or communications we send to you should be in writing.  When using our site, you accept that communication with us will be mainly electronic.  We will contact you by e-mail or provide you with information by posting notices on our website.  For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.  This condition does not affect your statutory rights.

18.  Notices

All notices given by you to us must be given to TLC Beauty Therapy, High Meadows, Wilsden, Bradford, BD15 0HN OR enquiries@tlcbeautytherapy.com. We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified in clause 15 above.  Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter.  In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail that such e-mail was sent to the specified e-mail address of the addressee.

19.  Transfer of rights and obligations

19.1 The contract between you and us is binding on you and us and on our respective successors and assignees. 

19.2 You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent. 

19.3 We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

20.  Events outside our control

20.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event). 

20.2 A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

(a)    strikes, lock-outs or other industrial action;

(b)    civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;

(c)    fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;

(d)    impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;

(e)    impossibility of the use of public or private telecommunications networks;

(f)    the acts, decrees, legislation, regulations or restrictions of any government; and

(g)    pandemic or epidemic.

20.3 Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period.  We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

21.  Waiver

21.1 If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.

21.2 A waiver by us of any default will not constitute a waiver of any subsequent default.

21.3 No waiver by us of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with clause 16 above.

22.  Severability

If any court or competent authority decides that any of the provisions of these terms and Conditions or any provisions of a Contract are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

23.  Entire agreement

We intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of any Contract. While we accept responsibility for statements and representations made by our duly authorised agents, please make sure you ask for any variations from these terms and conditions to be confirmed in writing.

24.  Our right to vary these terms and conditions

24.1 We have the right to revise and amend these terms and conditions from time to time.

24.2 You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Dispatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).

25.  Law and jurisdiction

Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law.  Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) will be subject to the exclusive jurisdiction of the courts of England and Wales.

26.  Third party rights

A person who is not party to these terms and conditions or a Contract shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.

Our website uses the advertising facilities of Mailchimp. Mailchimp have already implemented strong privacy protections which means they handle all subscribers data appropriately and inline with EU legal requirements.

When subscribing to our mailing list, any information, communications, or materials you submit to us is processed by the advertising platform. We cannot control the actions of the platforms themselves. Your interactions with those features and platforms are governed by the privacy policies of the companies that provide them.

Our Website include links to other websites. In particular, when making payment for goods by Paypal you will be directed to Paypal.com, when making payment by Credit Card you will be directed to Stripe.com to process the payment. If you submit Personal Information to either of those sites, your information is governed by their privacy policies.
